The Adelaide Hills Council area is located to the east of metropolitan Adelaide. It encompasses an area of 795 square kilometres and extends from Mount Bold Reservoir in the South Para Reservoir in the north and from the Hills Face escarpment in the west to the eastern boundary of the Onkaparinga watershed.
The physical character of the area reflects the geological history and includes:
• Hills Face and Foothills
• Eastern Range
• Central Range
The Council district is substantially within the traditional lands of the Peramangk Aboriginal people. The traditional land of the Kaurna people is also represented within the district at the foothills suburbs of Teringie and Rostrevor and down onto the Adelaide Plains.
The district holds special significance as a major environmental and recreational asset. The majority of Adelaide Hills Council lies within the Mt Lofty Ranges Watershed which supplies around 60% of metropolitan Adelaide’s water supply. The area has a wide range of land uses including agriculture, residential, retail, industrial, conservation and tourism.
Residential development varies from the more urban areas of the foothills and around Stirling to the rural townships of Gumeracha, Mt Torrens, Mylor and Cudlee Creek. There are over 50 towns and localities within the Council area.
European settlement in the Adelaide Hills began soon after the establishment of colonial government in 1836. It was one of the earliest settled areas in South Australia due to its close proximity to metropolitan Adelaide, high annual rainfall and fertile valleys.
In recent years, parts of the district have become increasingly urbanised due to better access to Adelaide City via the South Eastern Freeway and also people’s desire to enjoy the quality of life offered by a country location in close proximity to the city, giving impetus to development centred around the towns of Stirling, Bridgewater, Aldgate, Balhannah and Woodside. Improved transportation routes have also influenced population growth in the towns in the north of the area, such as Birdwood, Gumeracha and to a lesser extent Kersbrook.
Local industries include apple, pear and cherry growing, vineyards, mixed farming, quarries, nurseries, market gardening, grazing, forestry, horses and cattle.
Major tourist attractions in the Adelaide Hills Council district include - Cleland Wildlife Sanctuary, Mt Lofty Summit, Birdwood National Motor Museum, Gumeracha Toy Factory, Warrawong Wildlife Sanctuary, Melba’s Chocolate Factory, Mt Lofty Botanic Gardens and the Gorge Wildlife Park.
The AHC population growth rate has been steadily declining since 1991. The estimated growth rate for the 1995 to 2000 period was 0.2%, half the State’s average of 0.4% however, there was a surge in 2000 and 2001 in the order of 0.5% per year. The population is currently estimated at 39,028 as at June 2005. It is expected that the population will grow to 40,403 by 2016.
For people 60 years and older, the percentage is considerably lower than the average for the State as a whole, but is growing in percentage terms. Just over 11% of the population is over 65.The ageing of the population will have impacts on service provision, which is being addressed as part of our Community Plan. Improvements in aged services and infrastructure like footpaths will be required to improve access to facilities to older persons.
The AHC area has a relatively young and family-orientated population in comparison to the State as a whole. Young people aged between 10 and 24 years make up 20% of our population. Our youth population is expected to reduce by around 12% over the next 10 years, numbering around 7,400 people. For young adults (in the 20 to 29 year old age groups), there is a lower percentage than for the State as a whole.

Council issues guidelines regarding the health
and considered management of animals kept
in the area. Planning staff, General Inspectors
and Environmental Health Officers are all
involved as responsible officers with regard to
various aspects of animal management.
Wild animals are usually best left alone, however
an injured animal can be helped and specialist
assistance can be given by Fauna Rescue of SA
Inc. Familiarise yourself with this group at their
site.

Council recommends a few simple guidelines for
management of domestic animals.
Domestic birds eg, chooks, birds, peacocks
can be kept and conditions are outlined in
the guidelines, which can be obtained from
Council or Council’s website. If keeping chooks it
is recommended that there are no roosters due
to noise problems.

you wish to keep animals such as sheep, goats
or horses.
When a charity organisation wishes to raise
funds Council approval is required so that it
does not interfere with other organisations.

Approval of temporary
advertising signs/ banners
Council supports the use of temporary banners/signs
in designated areas by clubs, associations or
charitable bodies based in the Council area, which
announce a local event of a religious, educational,
cultural, political, social or recreational character.

Citizenship ceremonies are conducted by Council
throughout the year as requested. Larger ceremonies are
held on Australia Day.
To become an Australian Citizen, residents must first apply
with the Department of Immigration:

After the paperwork has been lodged with the
Department an interview and security checks are
conducted.
Once all of the Department of Immigration requirements
are satisfied (usually within about six weeks), the
Department then forwards the paperwork to Council.
Council then forwards a letter to the applicant advising
them that Council has received the paperwork and the
date of the next ceremony.
The applicant is then required to contact Council to
confirm their attendance at the ceremony.
Ceremonies are usually conducted on a weekday evening
every four to eight weeks depending on demand, and
at the Australia Day functions. If these dates are
unsuitable, alternative arrangements can be made.

The Adelaide Hills Business and Tourism Centre (AHBTC)
located at Lobethal in the former Onkaparinga Woollen
Mills buildings, is an initiative of Adelaide Hills Council,
to help develop new and growing businesses and increase
employment opportunities in the Adelaide Hills
Supporting Business
The AHBTC actively supports individual business
enterprise in the region of the Adelaide Hills and the Mt
Barker Councils. It works closely with Federal, Local and
State Government, together with other Business Enterprise
Centres (BEC’s) and business groups throughout Australia
and New Zealand to provide linkages with facilitators and
services that assist the growth and development of micro
and small businesses for the creation of job opportunities.
The AHBTC occupies a 10 hectare complex of small to
large manufacturing warehouses and offices. Situated in
Lobethal it utilizes the redeveloped Onkaparinga Woollen
Mills premises. The AHBTC has an extensive range of
premises that support new ‘start up’ business under a
Business Incubator program, tourism related businesses
that capture the history of the 120-year existence of the
Onkaparinga Woollen Mills, and light industry in permanent premises.
Business Incubator Program
The AHBTC ‘Business Incubator’ program is a major
program of the AHBTC providing a supportive
environment to new ‘start up’ businesses offering
mentoring, low cost services and advises on all aspects of
business. The Business Incubator Program has achieved an
80% success rate in maintaining small business viability.
This compares with a 20% success rate (nationally) for new ‘start up’ businesses starting without the support of a
Business Incubator.
The AHBTC is a member of the Australian & New Zealand
Association of Business Incubators (ANZABI).
In addition to the Business Incubator Program and its
commercial tenants, the AHBTC continues to develop and
promote tourism in the area.
A variety of factory, warehouse storage and office space is
available for short to long term use at competitive
commercial rates. The space is well located with good
support facilities and the advantage of a location with
other commercial tenants.

Council provides community grants to support local
initiatives which, in Council’s opinion, make a positive
contribution to community life through sport/recreation,
local cultural, community/social development,
environmental enhancements or address important social
and/or welfare needs.

Council Meetings are held on the first and
third Tuesday of each month at 6.30pm (public
holidays excepted).
Development Assessment Panel meetings are
held on the second Tuesday of each month at
6.30pm (public holidays excepted).
These meetings are held at 36 Nairne Road,
Woodside, (unless advertised otherwise) and
are open to the public.
Development within the Adelaide Hills Council
area can be complex due to the fact that:
• There are 5 catchments within the Mount
Lofty Ranges watershed that run through and
covers 85% of the area. Development is
restricted in these areas. Water from these
catchments flow into major reservoirs which
supply up to 60% of Metropolitan Adelaide’s
drinking water.
• All but a small portion of the Council area is
located in a bushfire prone area and the
majority of land along the western side is in a
high bushfire hazard area.
• Many properties contain Significant Trees or
Native Vegetation.
• Some properties within the area are listed as
either State or Local Heritage Places, or fall
within the Historic (Conservation) Policy Areas.
• The majority of land in the Council area is
under some form of primary production and
consideration of the impacts of such activities
has to be taken into account when assessing
developments.
• The vast majority of the Council area is not
serviced with any water, stormwater or sewer
services.
All the aforementioned aspects of the
Adelaide Hills Council area make it a special
and sometimes difficult area to develop in.

The following development activities require
approval, prior to any construction work,
vegetation or tree removal, site preparation or
excavation being undertaken:
Garages, sheds, verandahs, carports, pergolas,
dams, retaining walls (exceeding 1 metre in
height), swimming pools, fenced tennis
courts, fences (dependant on height),
change of land/building use, and new
buildings (including dwellings) and additions
or alterations to buildings.

(a) It is compulsory to register dogs when they reach the
age of three (3) months
(b) The registered owner of the dog must be a person 16
years or over.
(c) Dog registrations are for one year and are renewable
annually as at 1 July.
(d) The dog owner must advise Council immediately if:-
- the dog is moved to different premises
- the dog dies or is missing for more than 72 hours
- ownership of the dog is transferred to another person
(e) The dog must wear a collar with the registration disc
attached when in a public place.
(f) When in a public place a person must exercise effective
control of the dog in the following manner:-
- the dog must be held or tethered to a chain, cord or leash
no longer than two metres or
- the person is able to see the dog and be close enough to
give commands that the dog would obey.
(g) Fees:
Full registration is $40 per year or $24 per year if the dog
is desexed (proof required). (Pensioner and other
concessions can apply)
Council by-laws generally limit the number of dogs that
can be kept per household to two; however application in
writing can be made to have this number increased.
Special conditions apply.
You should notify Council immediately of the loss of your
dog giving full details of your name/address, phone
numbers, description of dog and registration details and
time and place the dog went missing. An after hours
service including weekends is available to report lost dogs.

Council has specialist Dog Management Officers available
to mediate and counsel should you become the victim
of a dog attack or harassment. If a complaint is received
the Officer will investigate and may issue a fine by
way of expiation notice or if the offence is more serious or
repeated the owner or the person in charge of the dog
may be summonsed to appear in court to answer to
a criminal charge. Council or a court may, instead of or in
addition to any fine, make other orders including that the
dog be destroyed, disposed of or controlled in a specified
manner. A court may also order payment and
compensation for any injury, damage or loss suffered as a
result of any action of the dog.
It is an offence if a dog creates a noise by barking
which persistently occurs or continues to such a degree
that it unreasonably interferes with the peace, comfort
or convenience of a person. Dog owners are responsible
for making sure that their dog’s barking does not
become a neighbourhood problem. Should this occur
Council Dog Management Officers could offer you advice
on means of correcting the habit including hire of training
videos, brochures and professional dog training
facilitators. Remember continual barking is an offence and
fines do apply.

and infrastructure investigation, design, construction,
operations and maintenance including roads, footpaths,
bridges, street lighting, verges, parks and playgrounds,
sports facilities, public buildings, waste services,
stormwater drainage and septic tank effluent drainage
schemes (STEDS).

property showing the proposed location of
the access. An application fee is applicable
when lodging an application.

This section is involved in matters relating to air, water and noise pollution and includes matters relating to management of effluent and other waste water. Environmental Health Officers undertake food inspections and investigate food related enquiries and follow up communicable disease issues. Fires in the open are not permitted on Sundays.
No fires are permitted during the Fire Danger
Season, without a permit

During the above time a prohibition will exist
on the lighting of all fires in the open air
WITH ONLY TWO EXEMPTIONS.
The following exemptions will be allowed on any day,
OTHER THAN A ‘TOTAL FIRE BAN DAY’:
1. A fire for cooking purposes and personal comfort
provided that:
1.1 The fire is contained in
(a) properly constructed fire place, or
(b) a portable appliance exclusively constructed for
cooking purposes;
(c) a trench at least 300mm deep, AND
1.2 The fire does not occupy an area in excess of 1.0m
square, and
1.3 The ground and air space within a distance of 4.0m from
the outer perimeter and upper most point of the burning
material is clear of all flammable material, and
1.4 A person who is able to control the fire is present at the
time it is lit until the time it is completely extinguished.
2. A fire for burning domestic or garden refuse provided that:
2.1 The fire is effectively contained within a properly
constructed incinerator, and
2.2 The supply of water adequate for the extinguishment of
the fire is readily available at all times when the fire is
burning, and
2.3 Under the conditions of 1.3 and 1.4 above.
Adelaide Hills Council is in the ‘Mt Lofty Ranges’ District’ in
respect to Fire Ban areas.
On TOTAL FIRE BAN DAY, only gas or electric appliances
will be allowed for cooking, and only within 15 metres of a
dwelling, and under the conditions of 1.3 and 1.4 above.
On total fire ban days, all types of barbeques are banned
in parks, reserves, ovals, tennis courts, and vacant blocks
or on any roadside, fire bans will operate from 12 midnight
and be in force for 24 hours.

These services are provided as part of the Home and
Community Care (HACC) program. The HACC program
gives support to people living in their own homes who
are frail, aged or have disabilities and it also supports
their carers. The types of services available to people
who fall within this category include home maintenance,
safety and security advice and installation, home help,
social support, respite services for carers, transport
assistance for essential appointments and referral services.
The Program is available in all Council wards however,
some services may differ between wards depending on
the needs of the local community and the availability of
funding.
The HACC program enlists the aid of volunteers to assist
in the provision of these services and provides training
and support for volunteer workers.
Council contributes towards the cost of running the Hills
Community Passenger Network (HCPN) which provides
information and support to people who are transport

The Local Government Act 1999 provides
that councils may impose a penalty of 2% on
any payment for rates whether by instalment
or otherwise that is received late. A payment
that continues to be late is then charged
a prescribed interest rate for each month it continues to be late. The prescribed
interest rate is set by the Local Government
Act (Regulations) 1999.
Council allows three working days should
the due date for payment fall on a non
working day as a grace period before applying
the late payment penalties allowed by the
Local Government Act 1999.
Council is prepared to remit penalties for
late payment of rates where ratepayers can
demonstrate hardship or in other exceptional
circumstances in accordance with Council’s
Policy for Remission of Fines on Rates.
Pensioner Concession
Eligible pensioners may be entitled to a
remission on rates, administered by SA Water.

A person who holds a State Seniors Card may be entitled
to a remission of general and separate rates under the
Local Government Act 1999, providing the land
constitutes the person’s principal place of residence.
However, a person is not entitled to receive both the State
Seniors Card concession and the pensioner concession.

The Hut offers a wide range of services to residents of the
Manoah, Mount Lofty and Marble Hill Wards. The Hut
activities include a variety of courses including computing
and digital photography, walking groups, young parents
group, social group for older residents, a community fun
and fitness group, strength and balance classes, men’s
shed and music for seniors. Other groups are formed in
response to community needs at the time.
The Hut also provides a community information service,
an information directory, an information kit for people
new to the district, tax help, a community bus and a
professional person providing listening skills. The Caring in
our Community programme provides neighbourly
support for local residents.

provides recruitment, training, and support
through Hills Volunteering and Learning

Council is planning to introduce a new kerbside waste

Changes to the Dog and Cat Management Act took place
on 1st July 2004. The State Government was prompted
to review the legislation following extensive publicity
being given to recent dog attacks against young children.
There has also been a steady increase in the number of
complaints against barking dogs, nuisance dogs and dogs
found wandering.
Some of the major changes to the legislation are listed
below:-
• dogs to be on a leash when in a public place
• stronger controls on menacing or dangerous dogs
• dogs to be adequately tethered when travelling in
utilities, tray top trucks etc
• stronger controls for dogs found wandering at
large
• stronger controls regarding barking dogs
• sixteen year olds are now allowed to register a
dog
• Councils are to prepare Dog Management
plans
• ‘off leash’ areas for dogs to be developed by
Councils.
Under state legislation, all dogs over the age
of three months need to be registered by the
owners at the local council. Re-registration is
due each year on the 1st of July.
The limit on the number of dogs kept shall be
according to Bylaw 5 – keeping of dogs:
• two dogs in a house
• three dogs and two working dogs on a rural
property

Some concessions do apply. Written proof of
desexing is required when registering a
desexed dog for the first time. Please notify
Council of any changes to the dog(s)
previously or currently registered to your
property (ie notify Council of any dogs
that have died, been sold or given away)
and especially if you change address.

eradication program to all landholders. In
order for the nests to be destroyed you need
to locate the nest. Tracking and finding wasp
nests is the responsibility of the landholder.
Once the nest is located contact Council’s

negotiated between the residentand contractor.

Council approval is required for a masonry (brick, cement,
etc) fence higher than one metre and any other kind
of fence (colorbond, galvanised iron, wooden, etc) higher
than two metres (measured from the lower of two
adjoining finished ground levels).
Fences located within a local or state heritage site or
within a Historic Conservation Zone require development
approval irrespective of its size. Fences with a height in
excess of one metre within 6 metres of an intersection
of boundary alignments on corner sites also require
Council approval.
Any fence less than 2 metres in height located on a
common boundary need to conform to requirements of
the Fences Act.
A booklet, prepared by the Legal Services Commission
of SA and available from Council’s Customer Service
Centre highlights the issues relating to fences and the law.
Council’s Technical Services Department are involved
in the decision making process of assessing development
applications for Development Approval in accordance
with the provisions of the Development Act, 1993.
Council assesses approximately 1700 development
applications per annum.

Council is the relevant authority in the processing of
Development Applications and enforcing offences in the
course of development being undertaken. However,
Council is not an authority in the case of civil disputes.
Noise from domestic premises, including music and party
noise, band and music practice, trail bikes, revving motor
vehicles, hammering and other non mechanical
construction noise is controlled by the Environmental
Protection Act 1993.
Council’s standard development condition for
construction states that construction should take
place between 7am and 7pm Monday to Saturday, with
the exception of public holidays. The builder must take all
practicable steps to minimise the impact of noise
emissions on neighbouring properties.
If the noise complaint is about a machine for which
maximum permissible noise levels have been set, and
which is being used during the specified times, noise level
measurements must be made by an authorised officer of
the Environmental Protection Agency.

Council has a statutory role to ensure the sale of safe food
within the District. Council’s Environmental Health Officers
are therefore involved in the following activities:
• Receiving and processing food business notifications
• Surveillance of food businesses to ensure compliance with
the relevant food safety legislation
• Follow up of consumer complaints regarding poor food
handling, contamination etc
• Follow up of confirmed food poisoning
• Providing advice regarding the fit-out of new food
premises or upgrades of existing businesses
• Providing general food safety advice to residents,
businesses and community and charity organisations.
The adoption of the new food safety legislation has
introduced a number of new requirements for both food
businesses and food handlers.
One of the significant changes to the food safety
legislation is the requirement for food business
proprietors to notify the existence of their business to
Council.

There are strict conditions which apply to the lighting
of fires in the Mount Barker District. For details of these
conditions contact Council on 8391 7200 or refer to the
Fire Handbook available from Council Offices.
The Fire Danger Season starts 1 December
each year and extends to 30 April unless
otherwise declared by authorities. For Fire Ban

ON DAYS OF TOTAL FIRE BANS, NO FIRES CAN BE LIT.
Domestic burning is discouraged. However,
should a resident need to burn off on their
property, this is only allowed outside of the
Fire Danger Season and then only from 10am
to 3pm Monday to Saturday. Burning on
Sunday is prohibited.
Wet matter and green garden waste are not to
be burnt, nor are plastics, rubber, wood and
similar materials.
Alternatives to Domestic Burning
There are a number of ways to dispose of
rubbish. A properly made compost heap only
takes up an area of about 2 square metres and
is clean and free of smell. Decomposable
household and garden waste can be treated
this way and eventually returned to the
garden. Townships have a Council rubbish
collection service which should be used for
hard rubbish. Other alternatives to burning
include chipping and mulching.
